I’m Daniel Hamilton, and when it comes to trust and estate planning, administration, and litigation in middle Tennessee, I’m one of the best attorneys around for affordable, approachable, effective service.

I’ve spent the last 10 years helping clients achieve their goals. I’ve drafted numerous estate plans that navigate difficult situations, and I’ve represented clients in contested probate and trust litigations. Estate law may seem overwhelming, but it does not have to be. My passion is to help clients understand the law and to prepare them for the future.

MY STORY

I’m a Nashville native. Let me be more specific. I was a Jess Neely allstar. I held a season pass to Opryland. I chased the flag when the Knights scored. I stood in line for five hours at a Western Auto to get Richard Petty’s autograph. I cut and hauled limbs out of East Nashville after the 98 tornado. I was a lifeguard at the Wave Pool. I danced in the district. I rocked with KDF. I was Nashville before it was cool.

After attending Western Kentucky University for my bachelor’s degree, I went to the University of Memphis for law school in 2008. I met my wife there, and we settled down in Memphis. I started my own practice and managed it for several years until our daughter was born. I then took a position with an estate planning and probate firm. After our son was born, we made the hard decision to move back to middle Tennessee so the children could be closer to their grandparents. We now live in Franklin with our children and two ungrateful rescue cats.

I am a husband and father. I understand the need and responsibility to plan ahead. I realize what’s at stake. I’ve also counseled many other spouses, parents, and grandparents. I’ve heard their stories, focused on their goals, and helped them plan.

As an independent attorney, I’m able to give more attention to my clients. With me, you are not just another “file at the firm”–you are my client, and I am your attorney. You will work with me. Period. This model helps me develop a quality relationship with my clients. As the need arises, we can still bring in other professionals, such as CPAs, corporate trustees, or real estate attorneys. We can use your existing advisors or seek assistance from my strong network of referrals.

My independence allows me to be flexible. I am equipped to meet clients by video (Zoom or Microsoft Teams), and it is not uncommon for me to meet clients at their financial advisor’s office or at their home.

Yes, I accept all major credit cards.

For estate planning, I usually quote a flat fee after the initial consultation. Estate planning fees typically range from $750 – $5,000 depending on the type of planning (e.g. wills vs. living trusts with numerous assets and sub-trusts).

For trust and estate administrations, I typically charge my hourly rate of $300/hour after the free consultation. Trust and estate administrations typically range from $5,000 to $15,000, depending on a variety of factors. Some of these factors include the number of beneficiaries, the nature and number of assets, whether a will or trust is involved, whether probate court is involved, the number of creditors involved, and whether everyone is in agreement.

For trust and estate litigation, I typically charge my hourly rate of $300/hour after the free consultation. I will often take a retainer for litigation cases. Depending on the situation, I am often able to offer contingency fee arrangements. It is hard to give a ballpark for litigation cases. The variables that drive fees are too many to list. It is best for us to discuss the case at the free consultation and then we can get a better idea of the fee situation.
