  • Lost or Destroyed Wills. Generally, you need the original document to probate a will in Tennessee. If you don’t have it, you may have a mountain to climb in probate court. In another situation, you may have proof that someone destroyed a loved one’s will to avoid probate. Either way, you will need an experienced attorney to represent you.
  • Trust or Will Contest. (i.e. Undue Influence or Lack of Capacity) In Tennessee, a person must have sufficient mental capacity and be free from the undue influence of another to sign a valid will or trust. If these issues are in question, litigation may arise to invalidate the document. Few attorneys are familiar with the nuances of will and trust contests. It is best to retain one with experience.
  • Breach of Fiduciary Duty. Fiduciaries (i.e. attorneys in fact, trustees, executors, administrators, conservators, and guardians) are the people in charge of an administration. They have specific duties in these roles. If they neglect or breach these duties, they may find themselves in a legal battle. It is best for both fiduciaries and beneficiaries to retain an attorney in these disputes.

Trust and estate administrations typically range from $5,000 to $15,000, depending on a variety of factors. Some of these factors include the number of beneficiaries, the nature and number of assets, whether a will or trust is involved, whether probate court is involved, the number of creditors involved, and whether everyone is in agreement.

For trust and estate litigation, I typically charge my hourly rate of $300/hour after the initial consultation. I will often take a retainer for litigation cases. Depending on the situation, I am often able to offer contingency fee arrangements. It is hard to give a ballpark for litigation cases. The variables that drive fees are too many to list. It is best for us to discuss the case at the initial consultation and then we can get a better idea of the fee situation.
